NCA Alert: NLRB Proposes Changes to Joint Employer Rules

The National Labor Relations Board (NLRB) will publish a proposed rule today that will significantly expand the definition of a joint employer. The proposed rule appears to state that joint employer status could be found if an employer simply “possesses the authority to control (directly, indirectly or both), or exercises the power to control one or more of the employee’s essential terms and conditions of employment.” NCA will continue to analyze the rule for its potential impact on private clubs and will likely join allies in filing comments. The proposed rule is subject to a 60-day comment period. You can see the NLRB press statement here.
