SCOTUS Reinstates Stay On Vaccine ETS

Today the Supreme Court of the United States (SCOTUS) reinstated the stay on the Occupational Safety and Health Administration’s emergency temporary standard (ETS) requiring vaccination or testing for employees at businesses with 100 or more employees. The stay will remain in place pending disposition of the suit in the 6th Circuit and petitions for writs of certiorari before the Supreme Court if filed. If the writ of certiorari is denied, the stay is automatically lifted. Effectively, the stay will remain in place until litigation is concluded up to and including possible action by SCOTUS.
