Oral Arguments Set on Florida Club Bylaws Case
The Florida Sixth Circuit Court of Appeals set March 2, 2023 as the date to hear oral arguments in a case the National Club Association filed an amicus brief in last year. The case, Fiddlesticks CC v. Potter, centers around whether the bylaws in effect at the time a member joins a club constitute a binding contract to remain in effect for the duration of that membership despite bylaw amendments properly adopted by a vote of the membership. NCA argued the lower court ignored established case law and the organic statute in its ruling and warned that clubs around the state would suffer significant negative effects if the ruling stands. NCA’s attorney in the case is requesting time during arguments to present its case.
FYI: Inflation Data Released Tomorrow
The Department of Labor’s Bureau of Labor Statistics will release January inflation figures tomorrow morning. Last week, inflation numbers for the month of December were adjusted to reflect an increase of 0.1% rather than the initially estimated drop of 0.1%. The adjustment raised concerns inflation may not be slowing as quickly as previously thought after November’s numbers came in lower than estimated. Mortgage rates increased last week after the adjustment and a much better than expected jobs report showed 517,000 gains compared to an estimated 187,000. The leisure and hospitality sector led job gains with 128,000.
House Conducts Hearings Outside D.C.
While the House is not in session for the next two weeks, several committees will hold hearings at locations related to their agendas. The House Energy and Commerce Oversight and Investigations Committee will be holding hearings in McAllen, Texas, on U.S.-Mexico border issues. The Biden administration has faced sustained criticism from Republicans for its handling of border security for the better part of two years and will use the field hearings as a means to raise additional attention to the issue. The Natural Resources Committee will meet at the University of Texas Permian Basin Midland Campus to discuss energy production.
Senate Votes on Court Nomination
The Senate will vote on a nomination to the Third Circuit Court of Appeals today and consider a cloture motion to end debate on another nomination to the District of Puerto Rico.
